McCloud remedy

Definition

A court ruling that the 2015 UK public sector pension reforms were age-discriminatory, giving affected members a choice between legacy and reformed scheme benefits for the 2015-2022 period.

The McCloud/Sargeant judgement (2018) found that the protections given to older members during the 2015 pension reforms unlawfully discriminated against younger members. The remedy gives affected members — those in service on both 31 March 2012 and 1 April 2015 — a one-time choice at retirement about whether their service between 1 April 2015 and 31 March 2022 should be in their legacy scheme or the 2015 reformed scheme.

The exception is LGPS, which handles McCloud through the 'underpin' — an automatic adjustment rather than a member choice. The right choice for NHS, TPS, and civil service members depends entirely on individual circumstances.
